Terms of Service
These Terms of Service (the "Terms") are a binding agreement between you and PropScan LLC ("PropScan," "SafetyNet," "we," "us," or "our") governing access to and use of the SafetyNet mobile application, safetynet.global, waitlist pages, community administration tools, and all related products and services (collectively, the "Services"). By creating an account, joining a community, using a waitlist, triggering an alert, responding to an alert, or otherwise using the Services, you agree to these Terms.
If you do not agree, do not use the Services. These Terms are drafted for a high-risk emergency-response product and allocate risk heavily to users and community operators.
1. Eligibility and Authority
- • You must be at least 18 years old, or the age of majority in your jurisdiction if higher, and capable of forming a binding contract, unless we expressly provide a permitted minor workflow through a parent, guardian, school, or community administrator.
- • If you use the Services for an organization, neighborhood association, property, church, school, HOA, employer, or other entity, you represent that you are authorized to bind that entity.
2. Nature of the Services
- • SafetyNet is a communications, coordination, and community-response platform. It is not a police department, fire department, ambulance service, emergency dispatch center, alarm monitoring company, security guard company, medical provider, legal adviser, investigator, insurer, or guarantor of any outcome.
- • The Services may attempt to notify users, responders, administrators, emergency contacts, or public safety agencies, but delivery, timing, accuracy, quality, and response are not guaranteed.
- • No feature, verification workflow, responder label, trust score, readiness score, background check, or community designation is a warranty of competence, honesty, safety, availability, legality, or successful intervention.
3. Account Registration and Verification
- • You must provide accurate, current, and complete information and keep it updated. We may require phone verification, identity checks, address confirmation, selfies, government IDs, references, or other information, and we may reject or revoke access in our sole discretion.
- • You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
4. Emergency Alerts and User Responsibility
- • You are solely responsible for deciding whether to trigger, forward, escalate, or respond to an alert and for the content, accuracy, legality, and consequences of any information you provide through the Services.
- • You must not submit false, misleading, exaggerated, malicious, harassing, defamatory, or unlawful alerts, reports, accusations, recordings, or leads.
- • You acknowledge that users may rely on information submitted through the Services, that emergency conditions are fluid, and that inaccurate or incomplete information may contribute to delayed response, property damage, bodily injury, emotional distress, arrest, investigation, or death. You assume all such risks to the fullest extent permitted by law.
5. Responders and Community Members
- • Any person who responds to an incident does so voluntarily, at their own risk, and subject to their own judgment. PropScan does not supervise, employ, direct, or control community responders merely because they use the Services.
- • Responders are responsible for complying with law, avoiding unsafe conduct, refraining from unauthorized entry, use of force, impersonation of officials, or medical intervention beyond their competence or authority.
- • Communities and administrators are responsible for their own membership decisions, local rules, training expectations, and response culture.
6. Prohibited Conduct
- • You may not use the Services to violate law, invade privacy, stalk, discriminate, harass, threaten, dox, impersonate, defame, interfere with emergency operations, spread misinformation, or test the system without permission.
- • You may not interfere with or bypass security controls, reverse engineer the Services except where non-waivable law expressly permits, scrape data, create fake accounts, or use the Services for surveillance, bounty hunting, vigilantism, commercial dispatching, or other unauthorized purposes.
7. Permissions, Devices, and Telecommunications
- • Some features require location access, camera, microphone, Bluetooth, notifications, background processing, telephony, SMS, or other permissions. You are responsible for configuring and maintaining your device, network, battery, and operating-system settings.
- • Carriers, operating systems, push providers, Bluetooth behavior, internet service, power failures, throttling, congestion, environmental conditions, or device-level restrictions may impair the Services.
8. Recordings, Evidence, and Cooperation
- • SafetyNet may automatically create or preserve recordings, metadata, logs, snapshots, transcripts, or other evidence relating to incidents or misuse. You consent to such creation, preservation, review, and disclosure.
- • We may provide records to administrators, users, law enforcement, courts, insurers, or other third parties when we determine that doing so is appropriate or required.
9. Intellectual Property
- • The Services, software, interfaces, branding, data models, and content provided by us are owned by PropScan or its licensors and are protected by law. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Services for their intended purpose.
- • You grant us a broad, worldwide, sublicensable, transferable, irrevocable license to host, copy, record, analyze, modify, display, distribute, create derivative works from, and otherwise use user content, incident content, feedback, and related materials for operating, improving, defending, and commercializing the Services.
10. Privacy
- • Our Privacy Policy is incorporated into these Terms by reference. In the event of conflict, we may determine which document controls for the relevant issue unless non-waivable law requires otherwise.
11. Service Changes, Suspension, and Termination
- • We may add, remove, suspend, or modify any feature, pilot, community, workflow, or integration at any time, with or without notice.
- • We may suspend, investigate, restrict, or terminate access for any reason, including suspected abuse, risk, legal exposure, inactive communities, failed verification, or operational concerns.
12. Disclaimers
The Services are provided "as is," "as available," and with all faults. To the maximum extent permitted by law, PropScan disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, availability, security, reliability, and that alerts or responses will be timely, received, acted on, or effective.
Without limiting the foregoing, PropScan does not warrant that any alert is true, that any response is safe or appropriate, that any verified user is trustworthy or competent, that any incident recording will be complete or admissible, or that use of the Services will prevent or reduce any harm.
13. Assumption of Risk
- • You acknowledge that using an emergency-response platform involves inherent and extraordinary risks, including false alarms, false leads, mistaken identity, non-response, delayed response, over-response, trespass, confrontation, self-help measures, escalation of violence, property loss, bodily injury, emotional distress, and death.
- • You voluntarily assume all risks arising from or related to: (a) triggering or failing to trigger an alert; (b) relying on any alert, location, map, media, recording, verification marker, or instruction; (c) traveling to, entering, observing, intervening in, or leaving an incident scene; and (d) any actions or omissions of users, responders, administrators, public agencies, or third parties.
14. Release
- • To the maximum extent permitted by law, you release PropScan and its affiliates, owners, investors, officers, directors, employees, contractors, licensors, service providers, agents, successors, and assigns from any and all claims, demands, liabilities, damages, losses, and causes of action arising out of or related to incidents, alerts, responses, community interactions, recordings, verification decisions, moderation decisions, or reliance on user-submitted information.
15. Limitation of Liability
To the maximum extent permitted by law, PropScan and its related parties shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, or for any loss of profits, revenue, data, goodwill, use, opportunity, personal safety, property, or business, even if advised of the possibility of such damages.
To the maximum extent permitted by law, PropScan and its related parties shall not be liable for any claims arising out of or relating to false leads, false or misleading alerts, non-responses, delayed responses, failed notifications, misdirected responses, dangerous responses, improper interventions, bodily injury, death, property damage, investigations, arrests, or third-party actions or omissions.
If, notwithstanding these Terms, PropScan is found liable, its aggregate liability arising out of or related to the Services will not exceed the greater of (a) fifty U.S. dollars (US$50) or (b) the amount you paid PropScan for the Services in the thirty (30) days before the event giving rise to the claim.
16. Indemnification
- • You will defend, indemnify, and hold harmless PropScan and its related parties from and against any and all claims, actions, proceedings, investigations, liabilities, damages, judgments, settlements, fines, penalties, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to: (a) your use of the Services; (b) your alerts, content, recordings, reports, or leads; (c) your response to or failure to respond to an incident; (d) your violation of law or these Terms; (e) your negligence, recklessness, willful misconduct, or misuse of the Services; (f) any claim that information you supplied was false, misleading, incomplete, invasive of privacy, defamatory, or caused injury or damage; and (g) any dispute between you and another user, responder, administrator, property owner, neighbor, invitee, agency, or third party.
- • Without limitation, you specifically agree to indemnify PropScan against negative consequences or claims arising from false leads, mistaken reports, inaccurate location data, unsafe or ineffective responses, escalation of incidents, property entry, confrontation, personal injury, wrongful death, or property damage allegedly resulting from your acts, omissions, content, or reliance on the Services.
17. Dispute Resolution; Venue
- • These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles.
- • To the extent allowed by law, any dispute shall be brought exclusively in the designated state or federal courts chosen by PropScan, and you consent to personal jurisdiction and venue there.
18. Injunctive Relief
- • You agree that unauthorized use of the Services or breach of sections relating to intellectual property, misuse, security, confidentiality, or user content may cause irreparable harm and that PropScan may seek injunctive or equitable relief without posting bond.
19. Changes to These Terms
- • We may update these Terms at any time. Updated Terms become effective upon posting or on the later date stated in the update. Continued use of the Services after the effective date constitutes acceptance.
20. General
- • If any provision of these Terms is held unenforceable, the remainder will remain in effect to the fullest extent possible, and the unenforceable provision will be construed to most nearly reflect its original intent.
- • These Terms constitute the entire agreement between you and PropScan regarding the Services unless a separate written agreement applies.
